A report on the situation of Mashallah Pesarkohan, a Jewish prisoner imprisoned in Greater Tehran Penitentiary

Monday, June 29, 2020 / Mashallah Pesarkohan, a Jewish citizen, incarcerated in brigade 5, ward 4, corridor 2, and cell 15 of the Greater Tehran Penitentiary has been denied access to medical services due to his severe ankle injuries and low eye strain.

According to Human Rights in Iran, Mashallah Pesarkohan, born on July 17, 1960, father of 2 children and a Jewish citizen imprisoned in brigade 5, ward 4, corridor 2, and cell 15 of the Greater Tehran Penitentiary who was severely injured in the ankle on Wednesday, June 24, 2020, has been deprived of dispatch to specialized therapeutic center. This Jewish citizen also suffers from poor eyesight and has been denied medical treatment. When this prisoner of conscience was sent on a temporary leave, his religious books were confiscated by prison guards after his return to prison. He is serving a 3-year prison sentence while his family members live in Israel and he is denied the right to make any phone calls to his family.

According to a credible source while talking to the reporter of Human Rights in Iran, it was said: “A few days ago, Mashallah Pesarkohan’s leg was stuck in a pit and he was severely injured. During this period, he was sent to Firooz Abadi Hospital in Tehran only once and returned to prison after a bandage without scan and examination by an orthopedic specialist. Also vision impairment is another problem for Mashallah Pesarkohan, who is already suffering from the disease, and on the other hand, this Jewish citizen is deprived of the right to be sent to the hospital for treatment of his teeth.”

The source continued: “After the leave that was granted to the prisoners at the time of the outbreak of coronavirus, Mashallah Pesarkohan was also sent on a leave, but after his leave and return to the prison, his religious books which were related to his religion “Judaism”, were confiscated by the officers in prison guard room.”

On March 5,2020, Mashallah Pesarkohan was sent on a 45-days leave, and after the end of his leave on May 6, 2020, he returned to the Greater Tehran Penitentiary to continue his imprisonment.

It should be noted that since the arrest of this Jewish citizen and prisoner of conscience, he has been deprived of the right to make telephone calls to his family living in Israel. He has faced other restrictions such as not being sent to a hospital for treatment of his nerve weakness, gastrointestinal disease, eye disease and tooth decay that caused him pain.

This Jewish citizen was detained to endure his 3-year prison sentence while he had not received a summons from the Tehran Criminal Court or the Revolutionary Court to serve his sentence.

Mashallah Pesarkohan was sentenced to 3 years in prison by branch 15 of the Tehran Revolutionary Court, headed by Abolghassem Salavati on charges of “entering the country of Israel”. Following the referral of the issued verdict to branch 36 of the Tehran Court of Appeals, presided over Ahmad Zargar, it was exactly upheld there.

After meeting with his family in Israel, this citizen was arrested by security forces on September 27, 2017, at Imam Khomeini Airport in Tehran on charges of “entering the country of Israel”. After the interrogation process and the referral of the case to court for completion, he was temporarily released on bail pending trial.

The repression of followers of other religions in Iran violates international human rights instruments, including Article 2 of the Universal Declaration of Human Rights, and Articles 18 and 19 of this internationally recognized document, as well as Article 18 of the International Covenant on Civil and Political Rights.

Also the individuals’ right to a fair trial is one of the inalienable rights accentuated in Article 10 of Universal Declaration of Human Rights.

Article 5 of the Criminal Procedure Code stipulates that the accused should be informed of the charges and provided access to a lawyer as soon as possible. Other defensive rights are mentioned in law, but extrajudicial actions taken by the security services violate the laws that they themselves drafted and claim to be enforced.
